Article 1: Orders
1.1 Placing an order: A firm order is placed when the customer clicks on the "I confirm my order" button just before the payment page. By placing your order, you are requesting us to purchase the products you have selected and placed in your basket. We reserve the right to accept or decline this offer at our discretion.
1.2 Confirmation of order: Condomplanet Sàrl confirms the acceptance of the order and its progress to the customer, to the e-mail address that the customer will have given us when registering on the site. This confirmation is effective when the customer receives an e-mail from Joujou.ch indicating that the order has been placed and "Order Confirmation" or "In progress". This e-mail thus forms a sales contract between you and Condomplanet Sàrl.
1.3 Order cancellation: Condomplanet Sàrl reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order.
1.4 Error in the recipient's details: In the event of an error in the recipient's details, Condomplanet Sàrl cannot be held responsible for an error in delivery or for the impossibility of delivering the product(s) ordered.
1.5 Postage: Orders under CHF 40.00 are subject to a surcharge of CHF 5.90 to cover administrative costs.
1.6 Age requirements: By placing an order, you certify that you are 18 years of age or older.
1.7 Retention of title: The products delivered remain the property of Condomplanet Sàrl until full payment has been received.
Article 2 : Prices
2.1 Price indicated on the order confirmation: The price invoiced to the customer corresponds to the price indicated on the order confirmation, on which any charges and discounts are displayed.The prices indicated on the order confirmation are binding, even in the event of price variations between the order date and the product delivery date.
2.2 Price error: In the event of a price error on a product, Condomplanet Sàrl reserves the right to modify the price. In this case, Condomplanet Sàrl will propose to the customer to cancel his order if the new price does not suit him.
2.3 Taxes and customs duties: Swiss VAT is included in our prices. For shipments abroad, our deliveries are based on prices in Swiss francs excluding taxes, on request. In the case of deliveries abroad, we do not charge VAT, but the customer will have to pay the VAT of his country (the country to which the parcel is sent) as well as any customs duties.
Article 3: Payment
We accept the following means of payment:
3-D Secure credit cards
Secure online payment by credit card uses SSL (Secure Socket Layer) protocol to ensure the confidentiality of information transmitted. Data is encrypted and cannot be read during the transaction. Once the transaction has been completed, your card details are not stored on our servers under any circumstances. We accept Visa, MasterCard and American Express.
Please note that the use of 3-D Secure technology may require additional verification on your part, in accordance with the security procedures established by your credit card issuer.
With your PostFinance private account, you can pay conveniently, simply and securely. The amount of your purchase will be debited directly from your PostFinance account at no extra cost.
Please note that to use this payment method, you must have a private account with PostFinance.
Invoice payments are payable within 30 days in partnership with Swissbilling SA. You will first receive your order, then, a few days later, the corresponding invoice will be sent to you directly by Swissbilling by post or electronically, depending on your choice.
Please note that using the Swissbilling service entails additional billing costs. The maximum amount for a first purchase with Swissbilling is CHF 500.00. The payment term is 30 days from receipt of invoice.
For security reasons, the billing address and delivery address must be identical, and delivery will be against signature. Before accepting your order, Swissbilling SA reserves the right to check your creditworthiness with the CRIF AG database in Zurich.
By choosing the method of payment on invoice, you declare that you have read and accepted Swissbilling's general terms and conditions of sale.
With Paypal, forget your credit card numbers and secret codes, your email address and a password are all you need. Using PayPal is simple and secure, and your financial information is never passed on to the merchant.
TWINT, a new 100% Swiss e-wallet system that works via a Smartphone application compatible with iOS or Android. TWINT requires no credit or debit card. All you need to do is load your TWINT account.

You can make your payment by bank transfer, making sure to mention your order reference number in the payment comments. Your order will be dispatched as soon as we have received the transaction amount in our bank account.
Please note that we reserve your order for a period of 10 days. After this period, if we have not received payment, your order will be automatically cancelled.
Please note that delivery times may be affected by bank transfer processing times.
Article 4 : Delivery
4.1 Deliveries in Switzerland and Liechtenstein: For orders delivered in Switzerland and Liechtenstein, postage is free if the order value is equal to or greater than CHF 50. Otherwise, a small-order charge of CHF 6.90 applies.
Customers can choose between delivery by PostPack Priority or Swiss Express parcel service, with or without signature. Once the order has been dispatched, the customer receives a tracking number to follow the progress of the order. Condomplanet Sàrl assumes no responsibility for lost or stolen shipments.
4.2 Deliveries to other countries: Our products are shipped via UPS Express, with a delivery time generally estimated at 2 to 3 working days from the date of dispatch. Orders for destinations outside Switzerland must have a minimum value of CHF 170.00.
For shipping and packaging costs, please note the following rates:
For countries such as Andorra, Austria, Belgium, Bulgaria, Denmark, Finland, France, Germany, Ireland, Italy, Luxembourg, Monaco, Netherlands, Portugal, Spain, Sweden, the contribution is CHF 39.90.
All orders shipped outside Switzerland are tax-free. However, at the time of customs clearance, the VAT applicable in the destination country will be calculated and invoiced to you, in addition to any customs charges.
4.3 Delivery times: For products in stock, Condomplanet Sàrl offers delivery within 24 to 48 hours. If the material is not in stock at the time of the order, the delivery time will be determined by the availability of the product(s) with the distributors/manufacturers. In the event of stock shortage, the delivery time is generally 3 to 7 days. We indicate the availability and/or estimated delivery time for each product, provided by the distributor(s)/manufacturer(s). This information is indicative and not guaranteed. Customers may request an estimated delivery time for their order by e-mail at any time.
Condomplanet Sàrl cannot be held responsible for any delay in delivery resulting from an error or delay on the part of the delivery service provider (Swiss Post). A delay in delivery resulting from an error or delay on the part of the delivery service provider does not entitle the customer to any compensation or refund, nor does it entitle the customer to cancel an order free of charge.
Article 5 : Right of return
5.1 Cancellation period: Condomplanet Sàrl grants its customers a cancellation period of 14 calendar days from delivery of the products. During this period, the customer may return the products, provided they are undamaged, unopened and still in their original packaging (control labels intact, not detached/torn/cut, etc.).
5.2 Return costs: For any return of goods or cancellation of an order, an administration fee will be charged. This fee amounts to CHF 20. It covers the administrative and logistical costs of processing the return. Shipping and return costs are at the customer's expense.
5.3 Exceptions to the right of withdrawal: The right of withdrawal does not apply to contracts for the supply of cosmetic products, such as lubricants, creams, cleansers, etc., as well as lingerie and silicone dolls.
Due to customs complexities and transport costs, the right of withdrawal does not apply to contracts for the supply of products abroad (deliveries outside Switzerland). Consequently, orders with delivery abroad are considered final and cannot be cancelled. In the case of deliveries abroad, Condomplanet SàRL (Joujou.ch) provides the customer with parcel tracking, but declines all responsibility in the event of partial or total non-delivery. It is the customer's responsibility to find out about any import restrictions, tax requirements and customs regulations in the country of destination before placing an order.
5.4 Warranty: Electrical and electronic products offered on JouJou.ch are covered by a 2-year manufacturer's warranty from the date of delivery. Other products are not covered by a warranty. In the event of repair or exchange of a defective product, there will be no extension of the warranty or renewal of the warranty period.
5.5 Return request: For all returns due to delivery errors, defective products, etc., a return request is mandatory. All return requests must be made via our contact form.
5.6 Defective products and products under warranty: Defective products covered by warranty will be systematically replaced by a new, identical product, unless the product in question is no longer available. In this case, the customer will be offered a credit note or a replacement item.
5.7 Return costs: In all cases, the customer is responsible for return shipping costs.
Article 6: Liability
6.1 Limitation of liability: These "General Terms and Conditions" determine all our obligations and responsibilities.We are not bound by any other warranties, conditions or provisions, except those expressly stated in this contract.
Any warranty, obligation or other provision regarding the products or services, whether by statute, case law or otherwise (including any implied conditions of quality, fitness for specific purposes and any duty of care), is expressly excluded.In particular, Condomplanet Sàrl does not warrant that the products are suitable for your intended use.
6.2 Exclusion of indirect or consequential damages: We shall not be liable under this contract for any loss of revenue, loss of profits, loss of contracts, loss of data or for any indirect or consequential damages of any kind whatsoever resulting from tort (including negligence), breach of contract or otherwise.Our total liability for any contractual or non-contractual fault (including negligence) or for any other cause shall in no event exceed the amount due for the products or services concerned.
6.3 Circumstances beyond our control: We shall not be liable for any loss or damage you may suffer as a result of our delay in performing, or our failure to perform, our obligations if such delay or failure is due to any circumstance beyond our control. In the event of delay, we will endeavor to perform our obligations as soon as possible.
6.4 Limitation of liability for products: Condomplanet Sàrl declines all liability for material, immaterial or corporal damage resulting from malfunction or misuse of the products sold.Likewise, Condomplanet Sàrl cannot be held responsible for any modifications made to products by manufacturers.In all circumstances, the responsibility of Condomplanet Sàrl is limited to the amount of the order and cannot be engaged for simple errors or omissions which could remain in spite of all the precautions taken in the presentation of the products.
Article 7: Buyer's acceptance
7.1 Acceptance of the general terms and conditions of sale:These general terms and conditions of sale and the price list are expressly agreed and accepted by the purchaser. The purchaser declares that he/she is fully aware of them and waives the right to invoke any contradictory document, including his/her own general terms and conditions of purchase.Confirmation of the order implies acceptance of these terms and conditions of sale.7.2 Age certification: The purchaser also certifies that he/she has reached the age of 18.These general terms and conditions of sale are intended exclusively for persons of legal age. By accepting these conditions, the buyer confirms that he/she is legally authorized to make purchases in accordance with current legislation.
7.3 Modifications to the general terms and conditions of sale: These general terms and conditions of sale are subject to change at any time without notice.It is the responsibility of the purchaser to regularly consult the general terms and conditions of sale updated on the joujou.ch website.
7.4 Disputes: This contract is subject to Swiss law. In case of dispute, Condomplanet Sàrl reserves the right to choose the competent court.
7.5 Other cases: For all other cases not governed by these terms and conditions of sale, the Swiss Code of Obligations shall apply.
